Terms of Purchase

Here you’ll find information about the terms that apply when shopping at thisisempatii.com.

Please note that these terms and conditions may change between purchases and should therefore be reviewed each time you shop with us.

The agreement is binding for both parties once the buyer has submitted their order to the seller.

PARTIES

The seller is VGN Works AS, Strandgaten 35b, 3060 Svelvik, hey@thisisempatii.com, org.no. 926 979 914, referred to hereafter as the seller.

The buyer is the individual placing an order in the online store and will be referred to hereafter as the buyer.

PRICES AND DISCOUNTS

All prices listed in the online store include VAT. We reserve the right to reject orders in cases of printing errors or price inaccuracies.

Discount codes always apply to regular-priced items and not to already discounted products. Certain discount codes are of a personal nature, and we reserve the right to reject any sale and deactivate discount codes if we suspect misuse. A maximum of one discount code is allowed per order. Note that offers apply while supplies last and within the time frame specified in our marketing materials.

For special offers that require an item to be included with the purchase, these conditions must be met. If you return items that do not meet the requirement, you will be charged the item’s regular price.

ERRORS, INACCURACIES, AND OMISSIONS

Occasionally, there may be information on our website that contains typographical errors, inaccuracies, or omissions that may relate to product descriptions, prices, promotions, offers, shipping costs, delivery times, and availability. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update information or cancel orders if any information on our site is inaccurate at any time without prior notice (including after you have submitted your order).

We take reservations for errors in our inventory. If we are out of stock on items you ordered, we will send the available items and credit the missing item(s), or cancel the order if we cannot deliver any of the items.

PRODUCTS

All size recommendations are for guidance only and will not necessarily fit everyone. Empatii cannot be held responsible for size choice if the product does not fit. Please check the size chart for measurements.

We’ve made every effort to display our products' colors and images as accurately as possible. However, we cannot guarantee that the color displayed on your monitor will be accurate. Some images used in our online store are illustrative and may differ from the actual appearance of the item.

SHIPPING AND DELIVERY TIME

Packages are shipped within 0-2 business days unless otherwise specified on the product page. If there is a delay, our goal is to inform you as soon as possible by email. During peak seasons, the buyer should expect longer delivery times. You will receive a confirmation by email when the order is shipped. For more precise information, you may contact us via the website chat or email at hey@thisisempatii.com.

We ship packages with tracking. You will receive a tracking number via SMS and/or email from Postnord when the package leaves our warehouse.

For domestic shipping in Norway, shipping is free for orders over NOK 999, and a flat rate of NOK 99 applies for orders under NOK 999 unless stated otherwise. The shipping cost will be calculated and added at checkout before you confirm the order.

We hold responsibility for the products until they are received by you at the delivery location, meaning when you have the products in your possession. For returns, you hold responsibility until we receive the products (they arrive at our warehouse).

If there is a delay in product delivery, we will inform you as soon as possible along with information on when delivery can be expected or whether the product(s) are sold out.

Depending on the nature of the products and the length of the delay, you may be able to withhold the purchase amount, request delivery, seek compensation, or cancel the agreement.

Packages not collected within two weeks are automatically returned to Empatii. This means you must pay for return shipping plus a handling fee (currently NOK 250) for uncollected packages.

RETURNS AND CANCELLATION RIGHTS

All items purchased at www.thisisempatii.com can be returned if notified within 14 days after receiving your order. The product you wish to return must be sent within 7 days of notifying us.

To return an order, please contact us via the contact form or at hey@thisisempatii.com. If the 14-day period has expired, the seller reserves the right to return the products to the customer.

Return shipping costs are borne by the customer.

Please note that the right of cancellation only applies to individual consumers and not business customers.

If you cancel the entire purchase, you will be refunded the item's value at the time of purchase within 14 days after we have received and processed the return.

If you paid by card, the amount will be returned directly to the same card used at the time of purchase.

If you wish to return all or part of your order and have chosen invoice as a payment method, you can extend the due date free of charge at www.klarna.no. If this is not done, a reminder fee may apply before your return is received and processed. We will update the invoice as soon as we have processed your return. If you have already paid your invoice, Klarna will contact you to obtain your account number for the refund.

For a full refund with returns/cancellations, the item must be returned in the same condition as when you received it, meaning with tags attached and free from smells, stains, or pet hair. If you return an item with smells, stains, or pet hair, the item will be considered used, and the amount will not be eligible for a refund.

Please contact us via the website chat or email at hey@thisisempatii.com as soon as possible, but no later than 14 days, if the item is damaged upon delivery or if you received the wrong item. Be sure to describe the issue and attach a photo of the defect when contacting us regarding a complaint.

Depending on the defect, we will offer one of the following:

  • If the item can be repaired, we will reimburse your expenses upon receipt of a receipt.
  • You will receive a new identical item.
  • You will be refunded the amount you paid for the item.
  • If you need to return the defective product, we will cover the return shipping cost.

PAYMENT

The seller may request payment for the item when it is shipped from the seller to the buyer.

If the buyer uses a credit or debit card for payment, the seller may reserve the purchase amount on the card at the time of ordering. The card is charged the same day the item is shipped.

Empatii uses Vipps, Klarna, and card payments through Stripe.

Card information is not stored, and all card data is processed through SSL encryption.

REVIEWS, FEEDBACK, AND OTHER SUBMISSIONS

If, at our request, you submit specific contributions (e.g., competition entries) or, without our request, you send creative ideas, suggestions, plans, or other materials, whether online, by email, by post, or otherwise, you agree that we may, at any time and without restriction, edit, copy, publish, distribute, translate, and otherwise use in any medium any comments you forward to us. We are and shall not be obligated to (1) maintain any comments in confidence; (2) pay compensation for any comments; or (3) respond to any comments.

INTELLECTUAL PROPERTY

As the buyer, you agree not to reproduce, duplicate, copy, or resell any products, images, or text from www.thisisempatii.com without our written permission.

PERSONAL INFORMATION

In accordance with the Norwegian Personal Data Act, we must ask for your consent to process your personal data. All personal data you provide to us or that we obtain will be processed by Empatii as the data controller.

The personal data you provide may be used to ensure deliveries to you, for credit assessment, and to inform you about our range. The information you provide is only available to Empatii. You have the right to access the information recorded about you and to request that Empatii remove or correct information about you. By accepting Empatii’s purchase terms, you consent to the above.
